Management

All non-domestic properties, including retail, commercial, and industrial, built before 1999, must have an up-to-date asbestos register, which is included within a survey and management plan. Legislation under the Control of Asbestos Regulations (CAR) 2012 regulation 4 – duty to manage required this survey to have been done, and any asbestos materials that were identified to be manged according to the recommendations.

The asbestos management plan is required, whether or not asbestos is present, because it will include the management survey document(s), renovation surveys, any details of asbestos previously removed, and certification of jobs.

Where asbestos is present, this should be included on the asbestos register.

Refurbishment

During refurbishment or renovation projects, it’s crucial to be aware of potential asbestos-containing materials (ACMs) that could pose a health risk if disturbed. An asbestos refurbishment survey is a systematic and specialised inspection conducted to identify and assess the presence of ACMs in areas where refurbishment or significant structural changes are planned.

Unlike other types of asbestos surveys, such as management surveys that focus on the routine management of ACMs, and demolition surveys that are performed prior to complete building demolition, the refurbishment survey is specifically tailored to the unique circumstances of refurbishment projects. This type of survey helps you fulfil legal obligations and prioritise safety throughout the renovation process.

This survey is required prior to any major refurbishment works for all buildings built prior to 1999. In reality, all refurbishment works of pre-1999 buildings, whether homes or commercial premises require this survey. Even a home in which a contractor is working becomes a place of work. Therefore, legally, an asbestos survey is required.

This is specified in the Control of Asbestos Regulations 2012 (Regulation 7).

Demolition

A pre-demolition asbestos survey (formally a type 3 asbestos survey) is used to locate and describe, as far as reasonably practicable, all asbestos-containing materials (ACMs) in the building and will involve destructive inspection, as necessary, to gain access to all areas.

Asbestos reinspection surveys play a crucial role in maintaining the safety and compliance of buildings and infrastructure. These surveys are designed to identify and assess the presence of asbestos-containing materials (ACMs) within structures. Asbestos, a naturally occurring mineral once commonly used for its fire-resistant and insulating properties, poses significant health risks when its fibres become airborne and are inhaled. An asbestos reinspection survey aims to mitigate these risks by ensuring the continued management, containment, and, if necessary, removal of ACMs.

Duty to Manage

Asbestos is the single greatest cause of work-related deaths in the UK” - Health and Safety Executive.

What is the duty?

The duty to manage asbestos is contained in regulation 4 of the Control of Asbestos Regulations (CAR) 2012.

  • Take reasonable steps to find out if there are materials containing asbestos in non-domestic premises, and if so, its amount, where it is and what condition it is in.
  • Presume materials contain asbestos unless there is strong evidence that they do not.
  • Make, and keep up-to-date, a record of the location and condition of the asbestos- containing materials - or materials which are presumed to contain asbestos.
  • Assess the risk of anyone being exposed to fibres from the materials identified.
  • Prepare a plan that sets out in detail how the risks from these materials will be managed.
  • Take the necessary steps to put the plan into action.
  • Periodically review and monitor the plan and the arrangements to act on it so that the plan remains relevant and up-to-date.
  • Provide information on the location and condition of the materials to anyone who is liable to work on or disturb them.

Who has the duty?

The dutyholder is the owner of the non-domestic premises or the person or organisation that has clear responsibility for the maintenance or repair of non-domestic premises.

Which premises are affected?

The duty to manage covers all non-domestic premises. Such premises include all industrial, commercial and public buildings such as factories, warehouses, offices, shops, hospitals and schools.

Non-domestic premises also include those 'common' areas of certain domestic premises, such as purpose-built flats or houses converted into flats. The common areas of these premises include foyers, corridors, lifts and lift-shafts, staircases, roof spaces, gardens, yards, outhouses and garages - but would not include the individual flats themselves. Common areas do not include rooms within a private residence that are shared by more than one household, such as bathrooms, kitchens etc. in shared houses and communal dining rooms and lounges in sheltered accommodation.

What can we do for the Duty Holder?

  • Provide the Asbestos Management Survey so that an Asbestos Register can be compiled.
  • Provide ongoing Asbestos Re-inpections to allow the duty holder to monitor and record the condition of the previously identified asbestos products within a building.
  • Write the Asbestos Management Plan that describes how it will be managed.
  • Provide the Pre-Refurbishment Asbestos Survey or Pre-Demolition Asbestos Survey prior to any planned refurbishment, modernisation or demolition works.
  • Advise on remediation where required and provide Asbestos Removal and Project Management services.
  • Provide Asbestos Training courses.
  • Provide on-going Asbestos Consultancy required.
